Last updated: June 2026. These Terms of Service govern your use of Lucitech's website design and hosting service. Please read them carefully — they explain how our service works, what you can expect from us, and what we expect from you.
1. Definitions
Throughout these Terms, certain words carry specific meanings. "Site" refers to the website and materials Lucitech creates for you. "Platform" means Lucitech's proprietary hosting infrastructure on which every Site runs. "Temporary Domain" is a Lucitech subdomain used while your Site is in progress, while "Production Domain" is your external, public-facing domain. A "Revision Cycle" is one complete round of changes to your Site, and the "Agent Service" is our automated text-message communication system for requesting updates.
2. Services
Lucitech provides managed website design and hosting built for small businesses. Base pricing is a one-time $100 setup fee plus $50 per month, with no long-term contract required. Lucitech does not offer self-hosted websites, source-code delivery, or migration services; all Sites run exclusively on Lucitech's Platform.
3. Fees and Payment
Our fees consist of a $100 one-time setup charge and a $50 monthly recurring charge, both of which are billed at the time of purchase. Clients cannot prepay beyond the setup fee plus the first month of service. A 14-day grace period applies to late payments; if an account remains unpaid and is suspended, a $100 reactivation fee applies to restore service.
4. Money-Back Guarantee
Refunds are available only within 7 calendar days after delivery of your first draft, only while the Site remains on the Temporary Domain, and only after at least 3 completed Revision Cycles. The guarantee covers the setup fee and the first month of service only; logo design fees, accelerated-delivery premiums, and any later months are non-refundable. When a refund is issued, the Site is permanently removed from the Platform.
5. Accelerated Delivery
Standard delivery of your first draft is 14 calendar days. Accelerated delivery options are available for an additional premium fee. If Lucitech misses a committed accelerated deadline, only the premium portion is refunded; the setup fee remains non-refundable.
6. Intellectual Property and Site Ownership
Lucitech retains exclusive ownership of all Site design, code, and assets that we create. During active service, the client receives a limited, non-exclusive license to use the Site, and may not copy, export, rehost, or reuse Site components elsewhere. Content you provide and own remains your property.
7. Logo Design Service
Each round of our logo design service produces five PNG files. The client selects one for use on the Site and receives all five files. Additional rounds are available for separate purchase, and logo design fees are non-refundable once work has begun.
8. Updates and Major Changes
Your monthly fee includes unlimited updates requested through the text-message Agent Service. Requests that fall beyond the Agent Service's scope incur a $100 "Major Change" fee, as determined by Lucitech. Examples of Major Changes include full redesigns, multi-page reimplementations, JavaScript-driven features, and custom integrations.
9. Support and Uptime
Lucitech aims to provide a first response to support inquiries within 24 hours, though we do not guarantee a resolution time. Our target is 99.99% monthly uptime, excluding scheduled maintenance, and verified downtime earns a 2x prorated service credit. This commitment excludes third-party failures, network outages, DNS issues, DDoS attacks, force majeure events, and issues caused by the client.
10. Domain Names
Clients may connect an existing domain to their Site at no charge and are responsible for their own DNS configuration. Domains that Lucitech purchases on a client's behalf are registered in Lucitech's account, and a $50 transfer-out fee applies to move such a domain to the client's own registrar.
11. Acceptable Use
Adult content and illegal material are prohibited on the Platform. Lucitech may remove, suspend, or terminate any Site that damages our reputation, our shared IP pool, or our infrastructure, and may respond to complaints at its discretion without obligation or liability.
12. Client Responsibilities
The client is solely responsible for the accuracy, legality, and compliance of all content, and must verify all copy, claims, prices, and contact information. The client is responsible for any industry-specific regulatory compliance, including HIPAA, FTC, accessibility, and similar requirements. Lucitech provides no legal, regulatory, medical, or financial advice.
13. Suspension and Termination
Clients may cancel monthly service at any time, with cancellation effective at the end of the current billing period and no partial refunds. Lucitech may terminate service immediately for violations of these Terms, non-payment, or harmful conduct. Termination takes the Site offline; client-owned content is available for download for 30 days following termination.
14. Warranty Disclaimer
Services are provided "as is" and "as available" without warranties of any kind. Lucitech disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees about business outcomes, revenue, leads, SEO rankings, traffic, or conversions.
15. Limitation of Liability
To the fullest extent permitted by law, Lucitech's maximum liability is limited to the total payments made by the client during the preceding 3 months. Lucitech is not liable for any indirect, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost data, lost goodwill, or business interruption.
16. Indemnification
The client agrees to indemnify and hold Lucitech harmless against any claims arising from client-provided content, the client's use of the service, violations of these Terms, violations of law, infringement of third-party rights, or any product or service claims made on the Site.
17. Dispute Resolution
Disputes are resolved first through mediation and then through binding arbitration in Pinellas County, Florida, with the client bearing mediation and arbitration costs. These Terms are governed by the laws of the State of Florida. Clients waive the right to a jury trial and the right to participate in a class action. Notwithstanding the foregoing, Lucitech may seek injunctive relief in court to protect its intellectual property.
18. Privacy
Our handling of personal information is governed by our separate Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand what we collect and how we protect it.
19. Modifications to These Terms
Lucitech may modify these Terms at any time. Material changes are communicated by email or by posting on the website. Continued use of the service after changes take effect constitutes acceptance; if you disagree with a change, your remedy is to cancel service.
20. Miscellaneous
Lucitech is not liable for delays or failures caused by events beyond its reasonable control (force majeure). Clients may not assign their rights without Lucitech's written consent, while Lucitech may assign its rights freely. If any provision is found invalid, it is severable and the remaining provisions stay in effect; no failure to enforce a provision waives it. These Terms, together with any order forms, confirmations, and the Privacy Policy, form the entire agreement between the parties.
